Information about application for building activities at
Moorabbin Airport.
Land use planning and building control at Moorabbin Airport is
regulated by the Airports Act 1996 (Act). This means that State law
does not apply and all building approvals for building activity on
Moorabbin Airport land are issued under Commonwealth law.
Regulations have been made pursuant to the Act, and the
regulations dealing with the approval of “building activities” (as
defined in S98 the Act) are the Airports (Building Control)
Regulations 1996.
Generally speaking building activities can only be carried out
after approval has been obtained from the Airport Building
Controller (ABC) for Moorabbin Airport. The Regulations set out the
way in which applications are made for approval of building
activities, as well as the matters the ABC considers before an
approval is issued.
A building activity is defined as:-
- Construction of buildings or other structure.
- Alterations to the structure of buildings or other structures.
- Constructing or altering earthworks (whether or not in relation to
a buildings etc.)
- Constructing or altering engineering, electrical or hydraulic
works.
- Demolishing, destroying, dismantling or removing.
- Building, structure, earthworks, engineering works, electrical
works and hydraulic works.
The approval process also involves obtaining the consent of the
Airport Lessee Company (ALC) which is Moorabbin Airport Corporation
(MAC).
The Regulations describe the things Moorabbin Airport must be
satisfied about before it gives its consent, such as whether the
proposed building activity is consistent with the Moorabbin Airport
Master Plan.
